06/20/2004: The
Fine Schedule is now in place for all WHF homeowners to view. It is advised that any homeowner with an outstanding violation correct the situation as any accessed fine will not be waived. All fines must be paid and it is strongly advised that all homeowners go back and read their closing documents. The PUD agreement and Purchase Money Deed of Trust, which are standard closing documents, state that HOA Dues and Assessments can be "Escrow Items" if the HOA contacts the lien holder for nonpayment. This means it WILL NOW BECOME PART OF YOUR HOUSE PAYMENT! These fines will be discovered up on any title search, that means during a refinance, foreclosure or sale, the balance will have to be paid. The use of collection agencies is another avenue for debt collection.05/14/2004: A Recall WHF HOA Meeting is scheduled for Tuesday, June 8, 2004 at 7:00 PM. The meeting will be held at the Windy Hill Farms Clubhouse. This meeting is required to elect Board members since we did not have a quorum of residents at the Annual WHF HOA Meeting on April 26. The proposal must be blocked in all of our interests. Please sign the petition when it comes around. If you know any homeowner in another affected community, please tell them we are coming as we all will need to work as a team and fight this. This petition will be drafted by weeks end and circulated within the community by mid April. Here is a scanned copy of the information and survey that was handed out at the meeting. It is strongly suggested that every homeowner in an affected community as well as any business, print, fill it out and return a copy immediately to TXU/Oncor.
03/07/2004 Special Note: There has been a bit of confusion on exactly what happens if the is no response to a homeowners ACC request. Summarized, the second to last paragraph in Article VIII Section 19 of the Covenants and Deed Restrictions means: If the ACC and Management company do NOT respond to an ACC request within 15 days, it is up to the HOMEOWNER to request an appointment with the Board of Directors. If no response is given by the Board of Directors after 15 days, the request is approved.
01/02/2004: The second "Meet the ACC" meeting held at the WHF Clubhouse sometime in February 2004. The WHF signs will be posted at all the community entrances as well as this website (WHF Calendar and News links) will be updated when the final arrangements have been made. This type of meeting will be held quarterly in the future.
01/02/2004: Covenants and Deed Restrictions Update:
The Board of Directors have approved the ACC's ability to issue fines for Covenants and Deed Restrictions violations. The fine schedule will be significant the first month with a monthly fine there after until the problem is resolved. The fine schedule will be broken up into two categories: anything structural and maintenance. There is a growing problem in our community with homeowners making changes without taking the appropriate action before any work begins. As a result, we have the some homes with the wrong color roofs, new pools, significant landscaping changes, several storage buildings, patio covers as well as several repeat offenders that do not maintain their current landscaping. The is an attempt to correct all of those problems at one time. Once the final schedule is submitted for approval to the Board, the HOA lawyer will file all the necessary paperwork.
The Covenants and Deed Restrictions will also be updated in the following areas: The parking of cars and trucks on the public street, the parking of "passenger trucks" on any affected lot or public street, mini satellite dishes, roof color and 6' Vs 8' fences.
12/01/2003: The HOA has changed management companies as of 12/01/2003. The new HOA management company is Principal Management. All clubhouse reservations, ACC request forms, complaints or any other HOA contact should be directed to Principal Management.
